Terms of use

The agreement between [Company name] and the businesses that build and run a store on MyStory. We wrote it in plain words. If something is unclear, write to us.

Updated

1.Who we are and what this covers

  1. 1.1

MyStory is run by [Company name] Ltd., company number [Company no.], [Address] ("we"). The service lets you build an online store, run it from one screen and sell in it ("the service").

  2. 1.2

These terms apply to anyone who signs up for or uses the service on behalf of a business ("you"), including staff you add to the account.

  3. 1.3

The service is for businesses and self-employed sellers. This agreement is between us and you. Sales between your store and its shoppers are between you and them.

  4. 1.4

The privacy policy and the accessibility statement apply together with these terms.

2.Signing up and your account

  1. 2.1

To use the service you sign up with correct, current details. Whoever signs up for a business confirms they may commit on its behalf.

  2. 2.2

You must be 18 or older to sign up.

  3. 2.3

Keep your sign-in details safe and tell us at once about any use you did not approve. You are responsible for what happens in the account, including what staff you added do.

3.The trial

  1. 3.1

A new store starts with a 14-day trial, with no credit card. During the trial you can build the store, add products and try everything.

  2. 3.2

The store stays closed to the public until you open it. A credit card is needed when you open the store to customers or connect your own domain.

  3. 3.3

We do not charge you before you choose a plan. If the trial ends and you have not chosen one, the store stays closed to the public. For 30 days you can still choose a plan or export what you built; after that we delete it as in section 10.

4.Plans, prices and billing

  1. 4.1

Plans and prices are on the pricing page. Prices are in shekels, before VAT.

  2. 4.2

Billing is in advance, monthly or yearly, on the card you saved, through [card processor]. The card details stay with the processor; we keep only a token to charge it. Every charge comes with a tax invoice and receipt by email.

  3. 4.3

Your plan renews at the end of each period until you cancel it.

  4. 4.4

A price change applies from the next period only, and we tell you by email at least [30] days ahead.

  5. 4.5

Plans include credits for the AI tools, as listed on the pricing page. You can buy more credits.

  6. 4.6

If a charge fails, we try again after one day, three days and seven days, and tell you each time. If payment still has not gone through, the store moves to coming-soon mode and closes to the public, and after 30 more days we delete it as in section 10.

5.No platform fee

  1. 5.1

We take no percentage of your sales, on any plan. What you pay us is the plan and any add-ons you chose, nothing else.

  2. 5.2

Payments from shoppers are collected by the card processor you connected to the store, under your agreement with them. Their fees, payout dates and refunds to shoppers are between you and them. We are not a party to those payments and never hold the money.

  3. 5.3

Third-party services you connect, such as invoicing, couriers and email marketing, have their own terms and prices.

6.Your store and your content

  1. 6.1

The products, photos, texts, orders and customer details in your store belong to you ("your content").

  2. 6.2

You allow us to store, show, back up and process your content only to run the service for you. That permission ends when the content is deleted.

  3. 6.3

You are responsible for your content and for what you sell: that you hold the rights to the photos and texts, that the products are legal and safe, and that prices, delivery and product details are correct.

  4. 6.4

You are also responsible for your duties to your shoppers: delivery, cancellation and returns policies under Israel's Consumer Protection Law, a privacy policy, an accessibility statement, invoices and your business details in the store. We draft these pages for you. The drafts are a starting point and not legal advice; check them and adapt them to your business.

  5. 6.5

Texts and images the AI tools prepare for you are suggestions. Check them before they go into the store. What is published in your store is your responsibility.

  6. 6.6

The MyStory system, the dashboard and our designs stay ours, and you may use them while your plan is active. [Licence terms for the design theme after you export the site: to be set in legal review].

7.Your data and export

  1. 7.1

You can ask for an export at any time: products, orders and customers as files, and the full WordPress site with its files and database.

  2. 7.2

For your shoppers' details, you are the controller of the database and we are the holder that processes it for you, as those terms are used in Israel's Privacy Protection Law. Details are in the privacy policy.

  3. 7.3

We back up the stores, but our backup does not replace an export you keep yourself.

8.What is not allowed

  1. 8.1

Do not use the service to sell or advertise anything the law forbids, including counterfeits, weapons, drugs and products that need a licence you do not have.

  2. 8.2

Do not send advertising without consent through the service, pose as another business, collect payment details by deception, or attack the security of the service, of other stores or of shoppers.

  3. 8.3

If you break this section, we may hide a product, close the store to the public or suspend the account. Where we can, we tell you first and give you time to fix it.

9.Availability, changes and support

  1. 9.1

We work to keep the service and the stores available all the time, but we do not promise there will be no faults or outages. Planned maintenance happens at quiet hours, and we announce it ahead when it affects your store.

  2. 9.2

The service changes and improves, and we may add, change or remove features. If we remove a main feature of your plan, we tell you [30] days ahead and you can cancel with no further charge.

  3. 9.3

Support is by email on every plan, and by priority WhatsApp on the Pro plan, as listed on the pricing page.

  4. 9.4

The address your store gets with us stays ours. A domain you connected is registered in your name, with the registrar you chose.

10.Cancelling and ending

  1. 10.1

You can cancel your plan at any time in Settings. Cancelling takes effect at the end of the paid period, and the store stays open until then. [Partial refunds on yearly plans: to be set in legal review].

  2. 10.2

We may end the agreement with [30] days' notice, or at once if you seriously break these terms, if payment is not settled as in section 4, or if the law requires us to.

  3. 10.3

When the agreement ends, for any reason, the store closes to the public and you have 30 days to export everything: products, orders, customers and the WordPress site. We remind you by email before that window closes.

  4. 10.4

After the 30 days we delete the store and your content, except what the law requires us to keep, such as billing records and invoices.

11.Liability

  1. 11.1

The service is provided as is. As far as the law allows, we are not liable for indirect damage, lost profits or lost data.

  2. 11.2

Our total liability to you is limited to what you paid us in the 12 months before the event.

  3. 11.3

You will indemnify us against third-party claims that come from your content, your products or your breach of these terms.

12.Changes to these terms

  1. 12.1

We update these terms from time to time. For a material change we tell you by email and in the dashboard at least [30] days before it applies. If you do not accept it, you can cancel before then with no further charge.

  2. 12.2

Using the service after a change applies means you accept the new version.

13.Governing law

  1. 13.1

Israeli law governs this agreement. The competent courts in [City] have exclusive jurisdiction.

14.Contact

  1. 14.1
